Visiting the website implies complete acceptance of all general terms and conditions of use mentioned below. These terms and conditions of use may be changed or added to at any time; visitors to the website are therefore encouraged to regularly consult said terms and conditions.

This website is normally accessible to visitors at any time. The website may, however, interrupt said access for technical maintenance reasons and visitors will be informed in advance of the dates and times of said interruption.

The website is regularly updated by Herbarom. Similarly, the legal information can be modified at any time. It is up to the visitor to read it as often as possible.

The website is designed to provide information about all the company’s activities. Herbarom will endeavour to provide the website with information that is as precise as possible. However, it cannot be held responsible for omissions, inaccuracies and missing information in the updates, attributable to it or to third party partners who provide this information.

All the information on the website is provided for information purposes only and may change. Furthermore, information on the website is not exhaustive. It may be subject to change after online publication.

4. 4. Contractual limitations on technical data

The website cannot be held responsible for any equipment damage associated with visiting the website. Furthermore, the website visitor pledges to access the website using recent equipment that contains no viruses using a recently updated, latest generation browser.

5. Intellectual property and counterfeiting

Herbarom owns the intellectual property rights and user rights for all elements accessible on the website, in particular texts, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication, adaptation of all or some of the website’s elements whatever the means or process used is prohibited, except with prior written authorisation from: Herbarom.

Any unauthorised use of the website or one of its elements will be considered a counterfeit action and pursued in compliance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code.

6. Liability

Herbarom cannot be held responsible for any direct or indirect damage caused by the visitor’s equipment when accessing the website, and resulting either from equipment that does not meet the specifications indicated in point 4 or from the appearance of a bug or incompatibility.

Herbarom cannot be held responsible for indirect damage (for example the loss of business or chance) consecutive to visiting the website.

Interactive areas (for asking questions in a contact space) are available to users. Herbarom reserves the right to delete, without prior warning, any content in this area that breaches legislation applicable in France, particularly concerning data protection. If required, Herbarom also reserves the possibility to implicate the visitor’s civil and/or criminal liability, particularly in the case of racist, abusive, slanderous or pornographic messages on any media (text, photograph, etc.).

7. Personal data management

In France, personal data is protected by law n° 78-87 of 6 January 1978, n° 2004-801 of 6 August 2004, article L. 226-13 of the Penal Code and the European Directive of 24 October 1995.

When visiting the website the following may be collected: the URL of links by which the visitor accessed the website, the visitor’s access provider, the visitor’s IP address.

In any case, Herbarom only collects personal visitor information for certain services available on the website. The visitor provides this information in full knowledge of the cause, particularly when he enters the information himself. It is specified at that time on the website that there is no obligation to provide this information.

In compliance with the provisions of articles 38 et seq. of law 78-17 of 6 January 1978 concerning computerised data, files and freedom, any visitor has the right to access, modify and oppose personal data pertaining to him, by writing and signing a request accompanied by a copy of their signed identification documents and specifying their address for a written response.

No personal information about visitors to the website is published, exchanged, transferred, sold or passed on to any third parties without the visitor’s knowledge. Only the purchase of Herbarom and its rights would enable the transmission of said information to the eventual purchaser who in turn would be subject to the same obligations for storage and modification of data concerning visitors to the website.

The website has not been registered with CNIL as it does not collect personal information.

The databases are protected by the provisions of the law of 1st July 1998 transposing directive 96/9 of 11 March 1996 concerning the legal protection of databases.

8. Hypertext links and cookies

The website contains a certain number of hypertext links to other websites, set up with Herbarom’s authorisation. However, Herbarom cannot check the content of these websites and cannot be responsible for this fact.

Browsing the website may lead to the installation of cookies on the visitor’s computer. A cookie is a small file that does not enable identification of the visitor; it records information about how the computer browses the website. The data is obtained to facilitate later browsing of the site and to help measure visitor statistics.
